Los Angeles County Museum of Art Membership’s 2019 Limited Edition Print Giveaway (“Giveaway”) OFFICIAL RULES

NO PURCHASE, DONATION, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER AND WIN, DONATION OR PURCHASE WILL NOT INCREASE CHANCE OF WINNING PRIZE.

Official Rules

  1. How to enter: Join, renew, or rejoin a Los Angeles County Museum of Art (“LACMA”) Membership at the Friend, Supporter, or Partner level between Sunday, September 1, 2019, 12 pm–Tuesday, October 15, 2019, 12 pm.

    Alternative Method of Entry: On a plain piece of 3” x 5” paper handprint your first and last name, street address (no P.O. Boxes), city, state, zip, date of birth (mm/yyyy), name of promotion, e-mail address plus daytime and evening telephone numbers including area code. Mail your entry in an envelope no larger than #10 (business-size envelope) with sufficient postage affixed to: Los Angeles County Museum of Art, Attn: Membership Department, 5905 Wilshire Boulevard, Los Angeles, CA 90036. This method of entry is open to all individuals who meet the eligibility criteria in section 2 below. Limit one entry per household. Entries must be received by Tuesday, October 15, 2019 at 12 pm. LACMA is not responsible for lost, late, illegible, mutilated, misdirected, postage-due entries or entries not received in time for the random drawing.
     
  2. Eligibility: LACMA Membership’s 2019 Limited Edition Print Giveaway is open to individuals who are 18 years or older as of the drawing date and permanent legal residents of the 47 United States of America (excluding residents of Alaska, Hawaii, Rhode Island, overseas military installations, Puerto Rico, the District of Columbia, and other U.S. Territories). Void where prohibited. Regardless of method of entry, only one (1) entry per household will be allowed. Duplicate entries will be disqualified.

    The following individuals are not eligible to enter or win the Giveaway: employees, contractors, representatives, agents, directors, and officers of LACMA and any other parties involved in the administration of the Giveaway and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings, in-laws, and, as applicable, the “steps” of each) and all persons living in the same household of each. By participating in this Giveaway, participants agree to be bound by these official rules (“Official Rules”) and by the decisions of LACMA in all matters relating to the Giveaway.
     
  3. Entry Period: The entry period for the Giveaway is Sunday, September 1, 2019, 12 pm–Tuesday, October 15, 2019, 12 pm. The drawing will take place on Monday, October 28, 2019 at 12 pm.
     
  4. Giveaway: The Winner will receive:

    • One (1) limited edition print titled Untitled (Los Angeles) by William Eggleston.

    Total approximate retail value of the Giveaway is $3,000. Entrants acknowledge that any costs incurred in redeeming the Giveaway, outside the listed items above, are not included in the Giveaway. LACMA makes no warranties with regard to the Giveaway. The Giveaway is not transferable and the winner has no right of substitution (in cash or otherwise). LACMA reserves the right to substitute a Giveaway of equal or greater value in the event of unavailability. Winner will be responsible for all expenses not specifically included herein, and all applicable federal, state and local taxes. Giveaway must be picked up by Winner during public museum hours within 30 days of Winner selection at LACMA’s offices located at 5900 Wilshire Boulevard, Los Angeles, CA, 90036.

    If Winner is unable to retrieve the Giveaway from LACMA located at 5900 Wilshire Boulevard, Los Angeles, CA 90036, during public museum hours within 30 days of Winner selection, and the Winner would like the Giveaway shipped to them, then the Winner will be responsible for all costs of packaging, shipping, and insurance necessary to deliver the Giveaway to Winner. LACMA will notify Winner of such costs in advance and payment must be received by LACMA before shipment. Shipping will only be permitted within the 47 United States of America (excluding residents of Alaska, Hawaii, Rhode Island, overseas military installations, Puerto Rico, the District of Columbia, and other U.S. Territories). LACMA is not responsible for any loss or damage to the Giveaway by the shipping carrier or other third party. If the Giveaway is not picked up or if no shipping arrangements are made with LACMA within 30 days of Winner selection, then the Giveaway will be forfeited.
     
  5. Odds of Winning and Winner Selection: There is one winner for one prize. The odds of winning depend on the number of eligible entries received during the Entry Period. However, we anticipate that the odds of winning a prize will range from 1:1,500 to 1:200,000. The winner of the drawing will be notified by email or phone call. The winner need not be present to win. If a winner does not claim their prize within 48 hours of being notified by email or phone, their prize will be forfeited and another winner will be selected and notified. Should three different winners fail to claim their prize, this Giveaway promotion will conclude. All decisions and selections are final and binding.
     
  6. Disclaimers, Dispute Resolution, and Limitations of Liability: LACMA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY GIVEAWAY OR YOUR PARTICIPATION IN THE GIVEAWAY.  By entering the Giveaway, each entrant hereby releases, and agrees to defend, indemnify and hold harmless LACMA, those working on its behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to such entrant’s participation in this Giveaway or the awarding, acceptance, use or misuse of the Giveaway or any other substitute Giveaway. Any and all disputes, claims, and causes of action arising out of or in connection with this Giveaway shall be resolved individually, without resort to any form of class action. This Giveaway shall be governed by, and construed in accordance with, the laws of the State of California, regardless of conflicts of laws principles. Any action or litigation concerning this Giveaway shall take place exclusively in the federal or state courts sitting in Los Angeles County, Los Angeles, and each entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each entrant agrees to service of process by mail or other method acceptable under the laws of the State of California. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY. REGISTERED CONTESTANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
     
  7. Privacy: Any personally identifiable information collected during an entrant’s participation in the Giveaway will be collected by LACMA or its designee and used only by LACMA for the proper administration and fulfillment of the Giveaway and as otherwise described in these Official Rules.
     
  8. Winner Name: For the name of the winner, send a stamped, self-addressed envelope after the Giveaway period to: Los Angeles County Museum of Art, Attn: Membership Department/2019 Limited Edition Print Giveaway, 5905 Wilshire Boulevard, Los Angeles, CA 90036.
